FERG Search (ABN 24 146 032 219) (“FERG Search”, “we”, “us” or “our”) is a specialist recruitment business operated by Fintan Ferguson and based in Melbourne, Victoria, Australia. We provide recruitment services across Australia, New Zealand, Singapore and the United Kingdom.
This notice explains how we collect, use, disclose and protect personal information about candidates, prospective candidates, clients, prospective clients, referees, suppliers and visitors to our website.

Information we collect
Depending on how you interact with us, we may collect:
- identity and contact details, such as your name, email address, telephone number and location;
- professional information, such as your employer, job title, work history, qualifications, skills, remuneration, work rights, availability and career preferences;
- application and recruitment information, such as your CV, interview notes, references, communications and information about roles for which you may be suitable;
- client and business-contact information, such as your organisation, hiring requirements and communications with us;
- information you submit through our website, including contact-form enquiries and CVs; and
- technical information generated when you use our website, such as your IP address, browser or device information and website activity, where this is collected by our website or service providers.
We do not intentionally collect sensitive information unless it is reasonably necessary for recruitment or another lawful purpose and we have the consent or other legal authority required to do so.
Where information comes from
We may collect information:
- directly from you, including through calls, emails, messages, forms, applications and interviews;
- from professional networking platforms and other publicly available sources, including LinkedIn;
- from professional contact-data and recruitment providers, including Lusha;
- from referees, current or former employers, clients and other people involved in a recruitment process; and
- from service providers that help us maintain or verify business and professional information.
If we obtain your information from another source, you can ask us for more information about the source and the categories of information we hold.
How we use information
We may use personal information to:
- identify and contact people about relevant employment or contracting opportunities;
- assess suitability, manage applications and introduce candidates to clients;
- provide recruitment and search services to clients;
- communicate with candidates, clients, prospective clients and other business contacts;
- verify information, conduct reference or other checks with appropriate authority, and prevent fraud or misuse;
- manage our relationships, records, systems, operations and legal obligations;
- improve and secure our website and services; and
- establish, exercise or defend legal claims.
Where UK data-protection law applies, our lawful bases may include taking steps at your request before entering a contract, performing a contract, complying with legal obligations, pursuing our legitimate interests in providing and developing recruitment services, and consent where the law requires it. We consider the nature of the information, the context and your reasonable expectations before relying on legitimate interests.
Recruitment outreach and your preferences
We may contact you where we reasonably believe a role or professional conversation may be relevant to you and the contact is permitted by applicable law.
You can ask us at any time not to contact you or not to use your information for direct marketing. We will act on the request and may keep the minimum information needed on a suppression or do-not-contact list so that we do not contact you again by mistake.
When we disclose information
We may disclose personal information to:
- clients and prospective employers where relevant to a recruitment process. We will not send your CV to a client without first discussing the opportunity with you;
- referees and organisations involved in authorised checks;
- technology and professional service providers that support our recruitment, communications, website, security, administration and legal compliance, including Bullhorn and Base44;
- regulators, courts, law-enforcement bodies and other parties where required or authorised by law; and
- advisers or parties involved in a proposed sale, restructure or transfer of our business, subject to appropriate safeguards.
We do not sell candidate CVs or personal information.
Overseas handling of information
FERG Search is based in Australia and works with people and organisations in more than one country. Some clients and service providers may access or process personal information outside the country in which it was collected. Depending on the service and recruitment process, this may include Australia, New Zealand, Singapore, the United Kingdom, the United States and Israel.
Where applicable law requires it, we take reasonable steps and use appropriate contractual or other safeguards for overseas handling of personal information. If UK data-protection law applies to a transfer, you may ask us for information about the relevant transfer safeguard.
Data quality, security and retention
We take reasonable administrative, technical and organisational measures to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.
We ask that you tell us if your information changes. We keep personal information only for as long as reasonably necessary for the purposes described in this notice, including to maintain recruitment relationships, comply with legal and regulatory obligations, resolve disputes and enforce agreements. When information is no longer required, we take reasonable steps to delete it or de-identify it. A minimal suppression record may be retained to respect a do-not-contact request.
